배심원단은 맥도날드 측 과실이 있다며 여성에게 약 300만달러의 손해배상금을 지급하라고 판결했다.

틀린 보도다. 배심원단은 평결^verdict을 하고 판결^ruling은 판사가 하는 거다. 배심원 없는 재판을 bench trial이라 하며 이 재판에서는 판사도 평결을 한다.

배심원단은 16만 달러의 전보 배상액과 270만 달러의 징벌 배상액을 평결하여 그 합은 286만 달러이다.

기사만 보면 맥도날드가 저 금액을 물어냈다고 이해하기 쉽다. 나쁜 기사다.

판사는 두 배상액들을 합해 64만 달러로 판결했다. 감액 판결을 remittitur라 하며 이거 역시 ruling이다. 하지만 당사자들은 이 판결을 거부하고 합의로 끝냈다. 합의한 금액이 공식적으로 알려지지 않았지만 판결 내용과 실무 관행으로 보아 50만 달러 아래인 거로 전해진다.
